 7th Pay Commission Projected Pay Scale

People may think that the babus again started to make voice over pay revision and next pay commission or 7th Pay commission. There is a saying that “The crying baby gets the milk”. The need makes the man to act.

One should try to understand the fact that being a government servant one can witness a considerable pay hike at least twice or thrice of his/her entire service period. Because, other than promotion, only the pay commission recommendation will give them considerable pay hike. But it takes place once in ten years. Now a days a government employee can render service 20 or 30 years only due to non availability of employment opportunity in government service below the age of 25. So there is no need to be get annoyed by hearing the voice for seventh pay commission from central government employees. Because constituting next pay commission is for nothing but to review the salary of the govt. servants with the current economical condition of the country.
How the pay of a govt. employee had been fixed at the beginning of the Independence India.

Till now there are six pay commission had been constituted to review and recommend pay structure of central government employees.

All the six pay commissions have taken many aspects into consideration to prescribe the pay structure for government servants.

In the first pay commission the concept of ‘living wage’ was adopted.

In second pay commission it had been reiterated that the pay structure and working condition to be crafted in a way so as to ensure the effective functioning of government mechanism.

The third pay commission adopted the concept of ‘need based wage’

The Fourth CPC had recommended the government to constitute permanent machinery to undertake periodical review of pay and allowances of Central Government employees, but which got never implemented.

In Fifth pay commission all federations demanded that the pay scale should be at par with the public sector. But the pay commission didn’t accept this and told that the demand for parity with the Public Sector was however difficult to concede as it felt that the Job content and condition of service in the government and pulic sector not necessarily the same. There were essential differences between the two sectors.

The Sixth Central Pay Commission, claimed that it had not only tried to evolve a proper pay package for the Government employees but also to make recommendations rationalizing the governmental structure with a view to improve the delivery mechanisms for providing better services to the common man

What about seventh pay commission?

Generally every pay commission, before recommending a pay structure, it used to analyze all the aspects including the economic situation of the country, financial resources of the government, comparison with the public sector, private sector and state government pay structure etc. So it is very much clear that Pay Determination is very complicated and sensitive task. Without any doubt every one accepts that this is very challenging task too. In order to determine the new pay structure the pay commission has to go through voluminous data consisting current economic condition, strength of the work force and working condition etc. In the meantime, if one tries to suggest or comment about 7thy pay commission pay scale or about what the seventh pay commission pay scale would be, it will not get much importance.

But when we come across all the recommendations of six pay commissions, we observed an interesting factor which is common to all the pay commission recommendations, particularly in the matter of percentage of increase in the pay. Average 3 times increase in the pay was recommended by each pay commission and it was accepted by government and implemented. We have posted three articles about six pay commissions before this post.

Obviously it is simple thing, we can say it a mathematical coincidence that we have in common in all previous pay commission, but we cannot neglect this. Because it was there, every time it is noticed that the revised pay was approximately three times higher than its pre revised pay. Apart from all the factors which has been used to determine the pay revision, we can use this simple formula ‘common multiplying factor’ to know the 7th pay commission pay scale . If next pay commission prefer to continue the same running pay band and grade pay system for seventh pay commission also, the pay structure may be like the following projected figures given below, using common multiplying factor ‘3’. Union Cabinet approved 8% DA hike wef 01.01.2013

The Union Cabinet on Friday approved 8% hike in the Dearness Allowance (DA) for central government employees and pensioners with effect from 01.01.2013.

'Merger of 50% of DA and DR with basic pay' - Finance Ministry not agreed to the Demand

  The below explanation was presented by the Minister of State for Finance Shri.Namo Narain Meena to the questions regarding merger of DA / DR with basic pay of Central Government employees and Pensioners in the Parliament on 14.12.2012.
Q: Whether various Associations/ Organisations of Central Government employees demanded merger of 50 per cent Dearness Allowance into the basic pay of Central Government employees and pensioners and the recommendation of the Sixth Central Pay Commission in this regard and action taken by the Government thereto?
Reply:Yes, A number of representations have been received from Associations/Organizations of Central Government Employees/Pensioners and individuals demanding merger of 50% of Dearness AHowance/ Dearness Relief with basic pay/pension respectively. The demand has been considered by the Government and not agreed to since the 6th Central Pay Commission has not recommended as such. 
The 6th Central Pay Commission did not recommend merger of dearness allowance with Basic Pay at any stage. Government accepted this recommendation vide Government of India Resolution dated 29.08.2008.

IN THE 12thDECEMBER STRIKE CONDUCTED BY NFPE AND ALSO IN THE STRIKE NOTICE FOR THE FEBRUARY 20 & 21 TWO DAYS STRIKE SERVED BY NFPE & FNPO ON 22.01.2013 THIS IS ONE OF THE MAIN DEMANDS. 

THE CENTRAL JCA IS MAKING ALL OUT EFFORTS TO GET THE PROPOSAL APPROVED BY THE FINANCE MINISTRY

Official Amendments to Lokpal and Lokayuktas Bill, 2011

The Union Cabinet has approved the proposals submitted by the Department of Personnel & Training for moving official amendments to the Lokpal and Lokayuktas Bill, 2011 as reported by the Select Committee of Rajya Sabha.

The Lokpal and Lokayuktas Bill, 2011 was passed by the Lok Sabha on 27th December, 2011. The Bill was taken up for discussion and passing in the Rajya Sabha on 29.12.2011. Discussions remained inconclusive. Thereafter, the Rajya Sabha adopted a motion on 21.05.2012 to refer the Bill to a Select Committee of the Rajya Sabha for examination and report.

The Select Committee submitted its report to the Rajya Sabha on 23.11.2012. The Select Committee has, in its Report, made recommendations suggesting amendments to Clause 3(4), 4(1 )(e), 14(1)(g), 14(1)(h), 20(1), 20(2), 20(3), 20(5), 20(6), 20(7), 20(8), 23, 25, 37, 46, 63-97 and Part-II of the Schedule. The Committee has also recommended consequential amendments in other provisions of the Bill as may be necessary.

Significantly, the Committee has recommended to do away with Part-III of the Bill which deals with setting up of the Lokayukta in the States. The Committee has recommended replacement of Part-Ill of the Bill with a new Section 63 which provides for setting up of the institution of Lokayukta through enactment of a law by the State Legislature within a period of 365 days from the date of commencement of the Act. Government has decided to accept this recommendation.

Some of the other important recommendations made by the Committee and decisions taken by the Government on them are as follows:

(a) In clause 3(4) of the Bill (dealing with disqualifications for becoming Member of Lokpal), the Select Committee has recommended that the words "connected with any political party" may be replaced by the words "affiliated with any political party", so as to overcome the ambiguity associated with the word "connected with any political party`". Government has decided to accept this recommendation.

(b) In clause 4(1 )(e) of the Bill (composition of the Selection Committee for selection of Lokpal), the Select Committee has recommended that the fifth member of the Selection Committee (i.e., eminent jurist) may be nominated by the President on the basis of recommendation of the first four members of the Selection Committee (viz.. Prime Minister, Speaker (Lok Sabha), Leader of Opposition (Lok Sabha) and Chief Justice of India). Government has decided to accept this recommendation.

(c) The Select Committee has recommended exclusion of bodies and institutions receiving donations from the public from the purview of Lokpal. Since bodies receiving donations from the public were also covered in the original Lokpal Bill, 2011 and the Department related Parliamentary Standing Committee had also endorsed this inclusion and had additionally, recommended the inclusion of entities receiving donations from foreign sources under the Foreign Contributions Regulation Act (FCRA), Government has decided not to accept this recommendation and seek an official amendment in the Bill as reported by the Select Committee. However, having regard to Section 10(23BBA) of the Income Tax Act (regarding exemption of income of bodies /authorities established under Central or Provincial Act for administration of public religious or charitable trusts or endowments or societies for religious or charitable purposes registered under Societies Registration Act), Government has decided to exempt only such bodies or authorities established, constituted or appointed by or under any Central or State or Provincial Act providing for administration of public religious or charitable trusts or endowments or societies for religious or charitable purposes registered under the Societies Registration Act.

(d) In clause 20(1) of the Bill, the Select Committee has recommended that the 
Lokpal should be given the power to order an investigation straightaway (without first ordering a preliminary inquiry) in case Lokpal finds that a prima facie case exists. Government has decided to accept this recommendation subject to the modification that the Lokpal should, before coming to a conclusion that there exists a prima facie case for entrusting the matter for investigation, call for the explanation of the public servant and only then decide whether there exists a prima facie case for ordering investigation.

(e) The Committee has recommended that in clause 20(2) of the Bill, the seeking of comments from the public servant during the preliminary inquiry should not be mandatory and has accordingly suggested the addition of the word "may" in the said clause. As the affording of an opportunity to the public servant and to the government/competent authority at this stage, would help clear doubts in several cases and would substantially reduce the number of cases going for regular investigation. Government has decided to oppose this recommendation of the Select Committee and move an official amendment for the purpose. Similar 
recommendation of the Select Committee to dispense with opportunity of hearing to the public servant before ordering regular investigation by the Lokpal in clause 20(3) of the Bill, is also proposed not to be accepted. 

(f) The Select Committee has recommended that 
the power to grant sanction for prosecution of public servants could be shifted to the Lokpal in place of the Government. The Select Committee has also recommended that Lokpal may be required to seek comments of the competent authority and the public servant before taking such decision. Government has decided to accept this recommendation.

(g) The Select Committee has recommended a number of amendments in the Bill with a view to strengthening the Central Bureau of Investigation (CBI), including (i) the setting up of a Directorate of Prosecution headed by a Director of Prosecution under the overall control of Director, CBI, (ii) the appointment of the Director of Prosecution on the recommendation of the Central Vigilance Commission, (iii) maintenance of a panel of advocates by CBI, other than Government Advocates, with the consent of the Lokpal for handling Lokpal referred cases, (iv) transfer of officers of CBI investigating cases referred by Lokpal with the approval of Lokpal, (v) provision of adequate funds to CBI for investigating cases referred by Lokpal, etc. Government has decided to accept all these recommendations except one. i.e. seeking approval of Lokpal for transfer of officers of CBI investigating cases referred by Lokpal, as it would, in Government`s view, affect the smooth functioning of the CBI.

WE ARE NOT GOING TO SURRENDER.

JOIN THE TWO DAYS STRIKE ON FEBRUARY 20 & 21

               We, the Postal employees, have a proud and inspiring history of participating in the freedom struggle of our country against the British imperialism and in the post-independent India against the onslaughts of the retrograde policies of the Government of India.  

Many of our leaders and comrades have sacrificed their life for the cause of the coming generation.  Job security, wages, pension and other service benefits are all the outcome of the struggle and sacrifice of hundreds and thousands of such comrades.  They faced dismissal, removal, suspension, increment cut, transfer to remote places, break-in-service and other severe victimisations.  Dies-non was not at all a punishment for them.  They never complained about wage-cut due to dies-non.  

           Not even  a single benefit was given by the Government without struggle and consequent heavy victimisations.  1st to 6th Pay Commissions were appointed by the Government only after the united struggle of the employees, each time.

               Now we are facing a very crucial and critical situation.  The ill-effects of the neo-liberal economic policies of the Central Government has become the greatest threat to the survival of the entire working class, especially Central Government employees including five and a half lakhs Postal, R M S and Gramin Dak Sevaks. 

            The question before us is -Are we able to protect our job security and hard-earned benefits?  Are we ready to fight or are we going to surrender before this attack?  

The answer is - No

We are not going to surrender.  

             We will continue our fight till the imperialist globalisation policies are thrown to winds, just as we have thrown the British imperialism out of our country.   We are not alone, crores and crores of workers and employees are with us in this fight.  We are ready for sacrifice.   We are not going to run away from  our responsibilities.  We shall face the challenge and continue our fight to change the system in our favour.  

            Ultimate victory will be ours.

               It is this uncompromising spirit and the readiness for sacrifice, that made National Federation of Postal Employees (NFPE) to join the two-days historic strike of the working class on 2013 February 20, 21.  The strike is being organised by the entire trade unions including INTUC, BMS and the left trade unions.  In the Postal, the strike is organised by Central JCA, including NFPE and the INTUC affiliated FNPO.  

             This is the first time in the history of India a cent per cent united strike of 48 hours by all the Unions and Federtions is taking place.  More than ten crores workers will participate in the strike.  The working class of India, in one voice, demand the UPA Government to change the imperialist globalisation policies.

               Central Government employees are the first victims of the neo-liberal economic policies pursued by the Central Government from 1991 onwards.  During the last twenty years about eight lakhs posts are abolished.  Still five lakhs posts are lying vacant in various departments.  Many departments are closed or privatised.  More and more casual and contract workers are engaged.  Social security schemes, including statutory Pension scheme are given a go-bye.  Instead, share market oriented contributory Pension scheme is introduced. 

               Three lakhs Gramin Dak Sevaks of the Postal department are denied of their legitimate rights.  Casual, Part-time, contingent employees are not given their due wage revision.  Even compassionate appointments are denied imposing arbitrary restrictions.  Bonus ceiling not raised.  

              Further the Government has declared the National Postal Policy 2012 which is nothing but a road-map to privatisation of Postal Services by granting licences to the multi-national courier services.

               The demand for appointment of 7th Pay Commission is not yet accepted, inspite of the thundering success of the 12th December 2012 strike organised by Confederation of Central Govt. Employees & Workers.  As an impact of the strike, all the Central Trade Unions have submitted a memorandum to the Finance Minister to announce constitution of 7th CPC in the February 2013 budget itself.  Still the Government is silent on Pay Commission and merger of 50% DA.  February 20, 21 strike is a continuation of 12th December strike.

               The steep rise in prices of essential commodities, disbanding of the public distribution system, deregulation of petrol and diesel prices , disinvestment of public sector, rise in unemployment, shrinking of employment opportunities, proposed move to amend the labour laws in favour of the employers, attack on social security, denial of assured pension for all, introduction of contract and casual labour system in all sectors, denial of minimum wage of Rs.10,000/- to industrial workers, refusal to remove bonus and PF ceilings etc. are all due to this neo-liberal economic policies.
              
                  The attack is all round.  

To save the Postal, 
to save the Central Govt. departments, 
to save the public sector, 
to save the common people and workers of our country 
including Postal employees 
the only way out is to fight back these policies.  

Let us wholeheartedly join this struggle 
and 
make it a historic success.
