Sub:- Periodic Medical examination relaxation for Loco Pilots declared with type II Diabetes - Amendment to Annexure-III (Para 509, 512) — 12.7.2 of IRMM- 2000.
Pursuant to the demand raised by Staff Side as DC/JCM item, the issue of relaxing the medical standards of Loco Pilots suffering from Diabetes Mellitus have been considered by the Board and the following has been decided -


Employees in safety category (A1, A2 and A3) & RPF who are suffering from Diabetes Mellitus can be declared fit for the respective categories if Diabetes is controlled on diet and/or on Tab. Metformin (oral hypoglycemic drug) upto 2gm/day only.


Periodic medical examination of such employee is to be conducted every year in addition to regular follow up as per the advice of the treating physician.
The in-service employee of A-one category who had been declared unfit due to Diabetes Mellitus prior to issue of this Board’s letter will not be considered for re-medical examination.
This issues in consultation with Safety, Mechanical, Electrical & Establishment Dtes. of Board’s office
Accordingly an ACS to Annex III (Para 509, 512)- 12.7.2 of IRMM-2000 is enclosed

National Pension Scheme gives mixed bag of returns


In a year when Employees’ Provident Fund gave a 9.5 per cent return and an over 8 per cent inflation rate ate into much of people’s income, the New Pension Scheme gave a mixed bag of results. Rising interest rates and volatile stock markets have impacted its returns in 2010-11 but, since inception, the NPS has managed to do better.
The performance review of fund managers for 2010-11 by the Pension Fund Regulatory and Development Authority has revealed that NPS for private citizens has managed to give higher returns than NPS for government employees.
Central government employees in NPS earned a return of 8.05 per cent to 8.45 per cent, much below the weighted average of 9.7 per cent in 2009-10. While UTI gave the highest return of 8.45 per cent, SBI gave the lowest return of 8.05 per cent. However, returns for state government employees in NPS was much higher, which ranged between 11.34 per cent and 9.88 per cent.
“It is about timing your investments as well as exposure to instruments,” said a PFRDA official. Central government employees who joined the service after 2004 are mandated to be part of NPS, which allows up to 15 per cent of the total corpus to be invested in equities, while the rest in corporate debt and government securities.
Private citizens, who were allowed to join the scheme from May 2009 can invest 50 per cent of their portfolio in equities and the rest in government securities and corporate bonds via one of the six fund managers — UTI Retirement Solutions, SBI, ICICI Prudential Life Insurance, Reliance Capital, IDFC AMC and Kotak Mahindra AMC.
Surprisingly, it is not equities but corporate bonds that was the top performer in the past one year.
“Equities have been the most volatile in the past one year, so corporate bonds and G-secs have given a higher return,” said Balram Bhagat, CEO, UTI Retirement Solutions, which was the top performing fund manager for NPS for central government, state government and the low cost NPS Lite.
The fund managers gave returns between 8.05 per cent (SBI) to 11.89 per cent (Kotak) for equities, which was a tad higher than the average return of 11.14 per cent from Nifty and 10.94 per cent from the Sensex. Equities as a class of investment, however, has given as high as a 17.85 per cent (ICICI) return since NPS was launched two years ago.
However, the usually staid and low-risk, low-return bonds and securities proved to be the dark horse, although PFRDA officials said that high interest rate regime has hit bond yields. Corporate bond yielded returns varying between 12.66 per cent (SBI) and 6.26 per cent (IDFC). G-secs have also given handsome returns. While UTI gave 12.52 percent, SBI gave 12.25 per cent. The lowest performer was IDFC with a return of 6.97 per cent in 2010-11.
PFRDA officials however cautioned that returns would be higher over a period of time as NPS corpus grows. The total corpus for central government employees is Rs 6,400 crore and for those of state is Rs 1,200 crore. The private sector contributed Rs 80 crore to the scheme.

Kindly refer to this office letter of even No. dated 1st April, 2011 wherein the operating procedure on the above subject was circulated. As already intimated, Service Discharge Benefit Scheme was implemented with effect from 1-4-2011. Therefore the monthly subscription @Rs.200/- (Rupees Two Hundred only) per month are to be credited in the accounts of account holders (GDS enrolled) as envisaged vide 9 of Part – II of Notification. But as seen from the concerned websites (of NSDL and CRA), the monthly subscriptions are not remitted by Postal Accounts Offices of all the Circles. The due date for the same is 5th of every month. It is therefore requested to issue suitable instructions to the Postal Accounts Office of your Circle. Since it is a continuous activity, a close and continued monitoring may be ensured.

While casting gradation list now, it should be as per current orders

If the Gradation list was prepared before 04.11.92, the date of confirmation is correct. But when, it is constructed now, how the confirmation can be taken when it was declared illegal by Supreme Court and Government had also dropped the earlier procedure.
When the Department has not prepared any Gradation list after the introduction of TBOP/BCR at Circle level since 1983, and constructing now how it can apply the old procedure? Will it not be against to the spirit of Supreme Court judgment and Government orders.
The Department shall reconsider this decision. We have taken up this case.

Dharna on 25-5-11at Gudur(AP)—Grand success

With all seriousness, a mass(maha) Dharna has been organized in front of Divisional Office/Gudur HO under the banner of JCA on 25-05-2011 from 10 AM to 5 PM. Public representatives, political party leaders, representatives from various organizations are invited.
High lights

1. Ten thousand pamphlets have been printed with details of privatization of postal services, closure of Post Offices, effecting deliveries and stared distribution to the public, through daily news papers and our postmen staff.
2. A big flexy(100 sq. feet) has been displayed permanently in front of Gudur HPO showing details of how public are going to loss of Postal services, the names of collapsed organizations so far after entering micknisey reforms.
3. About 150 members participated in Dharna.

3. Sri C.V.R.Kumar, Town secretary of CPI assured that they will extend full support to our struggle. Further requested the gathering employees should think over and elect such persons in general elections, who will the root cause for making the policies at higher level.
4. Sri K.V.Krishnaiah from Lok satta emotional spoke about the corruption at higher level and assured that he will sit for hunger strike if necessary to safe guard the postal services.
5. Sri Manapati Ravi from Prajarajyam assured that needful would be done.
6. Sri A.Kesavulu from Uited Teachers Federation(UTF) referred about formation of Disinvestment ministry(Sri Arun sowri) in NDA rule, which paved a way to privatize the Government organizations and the manner in which education filed entered. He assured full co-operation to our agitation and he would be with us till completion.
7. Sri Durgarao from LIC in his speech told that the manner in which they have conducted the struggles in insurance section against the privatization. He assured that from their side they will rally with other organizations in order to safe guard our Postal services.
8. Sri Ahamed from SWF(APSRTC) assured that they will do whatever required not to privatize Postal services.
9. Sri P.Prabhakar rao, a familiar Advocate enlightened about the importance of Postal services to the common man and praised our services when compared to other departments. He further told that each and every family in India has been benefited through Postal services and each family will react for our held definitely. He extended his full support to our struggle he will do the needful from his side.
10. Com Venkaiah from railway employees union expressed that they are also facing privatization problems severely and extended support to our struggle.
11. Com P.Panduranga rao, AGS,GDS union attended and gave a very good and effective presentation about privatization,the fate of other government sectors which are already privatized,the need of our unity and struggle ,if necessary to advance our struggle if the government adamantly move fastly to privatize Postal services.

Govt trashes proposal to increase babus’ retirement age

A government committee has rejected a proposal to increase the retirement age of government servants from 60 to 62. The decision is likely to impact over one lakh central government employees and 50,000 defence personnel on the verge of retirement. The proposal — which could have meant saving Rs.4,000 crore in this fiscal — was rejected as the government wants a younger bureaucracy.

CHARTER OF DEMANDS
1. Stop closure / merger of PO/RMS Offices including BOs. Review the orders implementing Speed Post Hubs and Delivery Hubs and restore status quo ante. Stop outsourcing the works of Postal, RMS & MMS functions.
2. Grant status as Central Civil Servant to GDS employees for all purposes including service matters, pay scale, increment, allowances, pension, promotion and other terminal benefits, leave, bonus and trade union facilities. Scrap new recruitment rules for appointment as postmen which curtails promotional avenues – restore previous rules and withdraw tighten norms assessing BPM's work. Drop reduction of allowances in case of reduction of workload.
3. Revise the wages of casual labourers and contingent employees w.e.f. 01.01.2006 based on the minimum pay recommended by 6th CPC. Stop outsourcing the work of casual labourers and contingent work. Grant temporary status to eligible full time casual labourers, Convert part time into full time absorb full time, part time contingent employees in vacant GDS posts.
4. Immediate revision of OTA & OSA rates.
5. Implement the assurances made on 12.07.2010 Strike Settlement and also the JCM Departmental Council Meeting held on 23.08.2010.( List enclosed) Ensure prompt holding of Departmental Council Meetings.
6. Immediate finalization of Cadre Restructuring proposals including Postal Accounts as assured by the Secretary Department of Posts and its implementation.
7. Stop decentralization of Postal Accounts, PLI and RPLI and ensure status-quo. Save DPLI office, Kolkata and ensure job security to the staff, DPLI.
8. Expedite the process of filling of all vacant posts in all Wings including GDS.
9. Stop implementation of Postmaster Cadre till finalization of Cadre Restructuring. Ensure 100% filling up of LSG, HSG-II, HSG-I before implementation of Postmasters Cadre, remove the retrograde eligibility conditions for appearing the examination of Grade I and PSS Group B and allow account line officials also.
10. Drop the proposed move of ending the services of existing System Administrators by outsourcing the technology work to the outsider agencies. Create the System Administrators Posts as assured and specified norms and other works and make the cadre as a promotional cadre to PA/SA.
11. Stop combination of beats /double duty, stop harassment of staff insisting 100% impracticable condition for delivery under Project Arrow. Settle the demands raised in the Postmen Committee such as distance factor, number of articles, Grant of Cycle allowance without distance condition, cash payment for uniform and kit items, Supply of good quality uniforms, Revision of norms.
12. Fixing norms for new assigned works of MTS. Allow to decline postman promotion for MTS under seniority quota and review the recruitment rules of MTS to Postmen / Mail Guards.
13. Grant promotions to Drivers / Artisans at par with other C.G. organizations like Railways/Defence. Higher Pay Scales to charge hand & Drivers. Revision of CRC EPP and Logistic norms.
14. Declare SBCO Staff as Divisional cadre, Stop harassment of SBCO officials under contributory factors. Complete the Ledger Agreement Work update the SBCO before launching Core Banking.
15. Fill up all Postal Civil Wing and Electrical Wing posts as per CPWD norms. Creation of Postal /Electrical and Architectural Division in every Circle. Expedite the Restructuring of Civil Wing Cadres.
16. Ensure full fledge functioning of newly formed Postal Accounts Offices by providing adequate staff strength and accommodation. Rectify the anomaly caused due to promotion of Group 'D' official to the cadre of LDC after 2006. Restore the residency period of three years in respect of JA to SA promotion retrospectively w.e.f. 13.12.2006. Grant MACP to those joined in Sorter cadre treating LDC as entry grade as the Sorter grade has been defunct since 2000.
17. Counting of past services rendered by erstwhile RTPs for promotions and MACP.
18. Implement Apex Court Judgement in case of RRR Candidates in true sprit and extend to all approved RRR Candidates awaiting for absorption.
19. Stop Harassing and victimization of innocent officials under contributory negligence factors. Implement the true spirit of Govt orders and Volumes and no recovery should be made if the concerned is not directly responsible for the loss sustained to the department.
20. Stop discrimination towards PO & RMS Accounts Cadre, Create separate cadre and earmark % of posts for norm based promotions in the same cadre, Count Special Allowance for fixation on promotion, Withdraw the recovery imposed on Postman Pay fixation and drawl of bonus to GDS. Restore the date of passing the Acct examination for according LSG promotions instead date of entry in PA cadre.
21. Enhance the LR strength on all cadres to the extent of 20% and fill up all vacant LR posts.
22. Ensure prompt grant of Child Care Leave as per the liberalized orders, unnecessary hurdles put forth should be dropped.
23. Review the MACP clarificatory orders and rectify the issues like, non drawl of spl allowance on acquiring MACP, wrong interpretation of IIIrd MACP to departmental promotes only after 30 years, Counting as double promotions as Group D & Postmen even in the case of promotion to Postman on GDS quota, non counting of training period for MACP, ignore promotions acquired on deptl exam for MACP, ignore all un-communicated average bench marks for MACP as Judicial verdict.
24. Stop attack on Union office bearers by misusing Rule 37 transfers and Rule 9 of CCS (CCA) Rules. Dispose all Rule 9 (Pension rules) disciplinary cases pending at Directorate years together.
25. Denying the legitimate right of employees to avail holidays & Sundays by compelling them to attend frequent meetings/ Melas.

CENSUS OF CENTRAL GOVERNMENT EMPLOYEES



The main factors of census of Central Government employees are given below for your ready reference.
(1). As per the result of Census Enquiries, the total regular employment under Central Government as per this census was 31.16 lakh as against 31.64 lakh of previous census.
The employment has, thus, recorded a decline of 1.52%.
(2). Employment in Ministry of Railways was the highest (45.32%) followed by the
Ministry of Home Affairs (22.20%),
Defense civilian (11.35%),
Communications & IT (7.75%) and
Finance (3.62%).
Other Ministries/Departments collectively shared the rest of 9.76% of the total Central Government regular employment.
(3). Out of 31.16 lakh regular employees,
3.20 lakh were women.
The proportion of women in the total employment shows an increasing trend.
It is 10.28% in this census against 9.68% in previous census and thereby indicating empowerment of women.


(4). About 96% of regular Central Government employees were Non-Gazetted.
The overall ratio of Gazetted to Non-Gazetted employees was 1:22.
In Ministry of Railways, ratio, however, was 1:116.
(5). Amongst regular Central Government employees,
57.80% were holding Group-‘C’ posts and
30.62% were in Group-‘D’ posts(now Group-C).
8.63% were holding Group-‘B’ posts
whereas employees holding
Group –‘A’ posts were only 2.95%.
(6). About 21.13% of the regular Central Government employees were found to be in Grade pay of Rs. 2000 to 24000/- and
only 0.47% employees were in highest bracket of pay range-HAG with drawing basic pay of Rs. 75,500/- & above.
(7). Amongst regular Central Government employees,
15.66% were working at offices located in ‘A-1’ class cities, 1
1.10% in ‘A’ class cities,
4.61% in B-I class cities and
15.31% in B-2 class cities.
The percentage of employees in ‘C’ class and other unclassified cities was 53.32%.
(8). Amongst States and Union Territory Administrations, the highest number of regular Central Government employees was in the State of
West Bengal (11.23%) followed by
Uttar Pradesh (9.97%),
Maharashtra (9.65%),
Delhi (6.61%),
Andhra Pradesh (6.44%) and
Tamil Nadu (4.66%).
In remaining States/U.Ts the proportion was less than 4%.

We are in receipt of encouraging reports from various circles and Divisions about the mobilisation by grass root level workers and leaders for the total participation of employees in the indefinite strike from 5th July 2011 as per the call of Central Joint Council of Action (NFPE, FNPO & GDS Unions)
Department’s move for implementing the Mckinsey Consultancy’s disastrous recommendations has resulted in allround protest and stiff resistance from employees especially in Chennai and Hyderabad. Chennai Postmen staff has went on three day’s strike and successfully resisted the Mckinsey reforms and halted it. Andhra comrades are conducting continuous agitational and campaign programmes throughout the Circle against the unilateral implementation of Mckinsey reforms. “Mckinsey Go Back” has become the slogan of the fighting comrades.
Postal Board is trying to go ahead with the Mckinsey reforms. Speed post hubs have resulted in erosion of public faith in the efficiency of this premium services. Now the department want to implement hubs for first class ordinary mails and registered articles. Total number of sorting offices will be reduced to 77. Further Chief PMGs have already sent proposals to Directorate for closure / merger of thousands of Post offices in urban areas. Privatisation and contractorisation of the Mail Motor Service (MMS) is also on the anvil. Opening of Franchise Post offices (Private Post offices) in a new name called “Post shoppe” and outsourcing of many other postal functions are also under serious consideration. Orders are already issued abolishing the sorting postman cadre altogether.
Gramin Dak Sevaks are facing the worst attack they have ever faced after independence of the country. Bonus has been reduced. Norms for cash handling and stamp sale drastically reduced. Norms for calculating the workload and allowances of Branch Postmasters have been curtailed resulting in reduction of allowances. Compassionate appointments limited to 10%. 25% of the Postmen vacancies are given to outsiders. And as a last blow, the GDS Conduct and Employment Rules has been changed and instead of “Employment” the word “Engagement” has been substituted. “Appointing authority” is changed as “Recruiting Authority”, thus permanently blocking the chances of GDS to be treated as Civil Servants. All the adverse recommendations of Nataraja Moorthy Committee are implemented one by one. The revision of wages of casual labours w.e.f. 01.01.2006 is still pending and the orders for outsourcing their work is not yet


withdrawn.
Many sectional demands listed in the 25 point charter of demands are yet to be settled. Cadre restructuring of all cadres, Decentralization of PLI and RPLI, Filling up of vacancies, Revision of OSA and OTA rates, Non implementation of JCM (Departmental Council) assurances, Non-settlement of demands raised in the Postman Committee, issues of MTS, parity in pay-scale and promotion to MMS Drivers, SBCO and Civil Wing issues, problems of Postal Accounts Staff, counting of services of ex-RTP staff, Discrimination towards PO and RMS Accountants Cadre, MACP anomalies, review of Postmaster cadre orders etc. are agitating the minds of the employees for the last more than one year.
Comrades, the very existence of Postal Department as a Government Services and its five lakhs employees is under threat from the Government. This is a question of “DO or DIE”. We have to face the challenge. We shall fight it out with all forces at our command. We are confident that we can stop this onslaught.
Let us prepare ourselves for a massive breakdown from 5th July 2011, which alone can compel the Government to come forward and settle the genuine demands of the Postal workers.

NOTIFICATION

G.S.R ... ... (E).- In exercise of the powers conferred by the proviso to article 309 and clause (5) of article 148 of the Constitution and after consultation with the Comptroller and Auditor General of India -in relation to persons serving in the Indian Audit and Accounts Department, the president here by makes the following rules further to amend the Central Civil Services (Conduct)Rules,1964, namely :-

1. (1) These rules may be called the Central Civil Services (Conduct) Amendment Rules, 2011.
(2) They shall come into force on the date of their publication in the Official Gazette.
2. In the Central Civil services (Conduct) Rules, 1964, in rule 18, -
(a) for sub-rule (3), the following shall be substituted, namely:

"(3) Where a Government servant enters Into a transaction in respect of movable property either in hi own name or in the name of the member of his family, he shall, within one month from the date of such transaction, report the same to the prescribed authority, if the value of such property exceeds two months' basic pay of the Government servant:

Provided that the previous sanction of the prescribed authority shall be obtained by the Government servant if any such transaction is with a person having official dealings with him.

(b) in Explanation I, in clause (I), in sub-clause (a), for the letters, figures and words
"Rs 10,000, or one-sixth of the total annual emoluments received from Government,
whichever is less", the words 'two months' basic pay of the Government servant, shall be substituted .

NFPE PROTEST ABOLITION OF SORTING POSTMAN CADRE

Sub: Abolition of separate cadre of Sorting Postman.

Ref: Directorate Memo No. 25-20/2008-PE-I dated 4.5.2011.

Madam,

Please refer to memo no. referred above. The Sorting Postman Cadre in the Department of Posts is in existence for the last more than one hundred years. The Directorate while changing the designation of Sorting Postmen has altogether abolished the cadre .The reasons stated is not at all convincing. It is fact that no separate pay band and grade pay is recommended by pay commission for the Sorting Postman. That does not mean that the designation of all the cadres which are in the same grade pay should be one and the same. In that case the name of Head Postman, Cash Overseer , Mail Overseer, Departmental Stamp Vendor are also to be changed as no separate grade pay is recommended for them also by the Pay Commission.

From the above it can be seen that, it is not the grade pay that decides the designation but the nature of duty .We can not simply go on changing the designation of Sorting Postmen, Cash Overseer, Mail Overseer, Departmental Stamp Vendor etc. only because the Pay Commission has not recommended separate grade pay for each such cadres.

We strongly protest the decision of the Department to change the designation of Sorting Postman and demand reconsideration of the decision and to restore status quo- ante

Will the Retirement Age of Central Govt. Employees go up from 60 to 62 ?

Retirement age stays 60, pensioners disappointedBut some say it’s a good decisionMany city pensioners’ associations awaiting a decision on extension of retirement age of central government employees were disappointed on Monday when the Department of Personnel and Training (DoPT) decided to keep it at 60 instead of 62.A senior member from the establishment department of the DoPT told Newsline, “It has not been discussed and we have not issued any orders or have taken any ‘in-principle decision’ on the same.’’“Though there was no official announcement, the news of the extension of retirement age was widely circulated among the departments,’’ said M Naik, associated with the central government.B J Piwal, a member of the central government employees for national confederation, said he was disappointed with no extension in the age. “Though we had no news or order from the seniors in the department, news which appeared on the Net about the extension gave us some hope. Two more years would have good,’’ he said.P K K Unni, a member of the central government association, said one has to think about the unemployed youth who are hoping to get government jobs. “The government is justified in not increasing the age as it will affect youngsters,’’ he said.The last time the government extended the retirement age of central government employees was in 1998. It was also a two-year extension from 58. This was preceded by the implementation of the Fifth Pay Commission, which had put severe strain on government finances. Subsequently, all the state governments followed the Centre’s policy by extending the retirement age by two years. Public sector undertakings too followed suit. A certain section of the employees serving in various government establishments feel that the news of the extension was more political with the government facing lot of corruption cases.P K Raje, another central government employee, said, “The rumour was earlier circulated last year as well. However, even if the government is not extending the age limit, it should recruit more people.’’ He said IMD Pune’s mechanical wing has many vacancies but there has been no news of filling up the posts


CAT CASE AGAINST PS GROUP "B " EXAMINATION & POSTMASTER CADRE



CAT case filed in Chandigarh bench was listed for today. The case has been adjourned to 24.05.2011 after having assurance from the Department that they will file written reply before the next date of hearing. If Department failed to do so, we will request Hon’ble Court to provide interim relief . In case the department filed the reply ,the case will be heard on merit.
I am receiving number of calls from my esteemed members to know the nature of case we have filed, whether it is against the PS Group “B” examination or Postmaster cadre. It is for the information of members that the case is neither against any examination nor Postmaster cadre. We are fighting for correct calculation of vacancies under each quota and promote the IP/ASP in their respective quota of vacancies. You will agree that there are 866 posts of PS Group B, out of which 649 (75% of total strength) posts have been earmarked for the promotion through seniority cum fitness from IP Line officials, 165(19%) posts through Limited Departmental Competitive Examination from IP Line and 52(6%) posts from General Line officials through examination. Now, since Postmaster cadre has been carved out by creating 116 posts from General Line ,(see Notification) then why and how the LDCE is being conducted for 6% General Line officials. As far as 19% quota is concerned ,the roster for this quota is already full. At present , 162 out of 165 posts are filled, how 32 vacancies have been calculated by the Department. Finally, we have demanded that there should not be any effect on 649 posts earmarked for promotion through seniority of IP Line officials. Examination should be held if there is any vacancy in their respective quota and distribution of vacancies for Examination should only be within 25% without effecting 75% quota.

Subject:- Departmental proceedings against Government servants consultation with the Union Public Service Commission for advice.
The undersigned is directed to say that this Department has been impressing upon various Ministries/Departments to complete the disciplinary proceedings by minimizing avoidable delays. In para 3.11.10 of the 4th report of the 2nd ARC titled “Ethics in governance”, it has been observed from a sample study that the Administrative Departments take more than 2/3th of the time taken to process the case under the CCS(CCA) Rules. In the sample study, the Inquiry Officers were found to be taking about 17% of the time and the UPSC about 5% of the time to conclude their findings. This Department has issued OM No.39011/12/2009-Estt.(B) dated 14.9.2010 reiterating that the requisite details in the proforma to be sent to the UPSC are properly filled up and sent with the relevant documents so that there does not arise occasion for the UPSC to make a back reference to the Ministries/Departments for the deficiencies found by the Commission in the papers sent to them.
2. The UPSC has brought to the notice of this Department that during the year 2010-11 the Commission had to return the case to the concerned Departments in more than 40% of the cases on account of procedural/documentary deficiencies. A list of the common deficiencies observed by the Commission i n these cases are given in the Annexure. All Ministries/Departments are requested to ensure that the deficiencies indicated in the Annexure are not repeated in the proposals being sent to the UPSC for seeking its advice on disciplinary matters.
3. Attention of Ministries/Departments is also drawn to this Department’s OM No.39011/12/2009 -Estt.(B) dated 16.11.2010 wherein it has been requested that in cases where the Courts are being apprised of the time taken in finalizing a disciplinary proceeding through affidavit, information in regard to the pendency of the matter before the UPSC may be correctly projected. The average time taken by the Commission in tendering advice in disciplinary proceedings is about 4 to 6 months. The Commission tender its advice in about 3 months in those cases where priority is attached due to direction of Court. In such cases, in order to expedite scrutiny of the cases a single window system on pilot basis had been introduced in the UPSC from September 2010 and initially 9 Ministries/Departments were included in the single window system. The Commission has now decided to extend the single window system to all other Ministries/Departments whose offices are situated in Delhi for submission of disciplinary cases involving court cases. Under this system, a Ministry/Department while referring the disciplinary cases to the Commission for advice, is required to authorize a representative, not below the level of Under Secretary, to hand over the case to the designated officer in the UPSC, with prior appointment. The cases received from a Ministry/Department are initially scrutinized on the spot, i n terms of information sought in the Proforma check list issued by this Department. Only cases which are complete as per the check list are accepted by the Commission for further scrutiny and examination. Incomplete cases are returned at the counter itself after pointing out the deficiencies. In UPSC, the case records are to be handed over to the Under Secretary(S-1),(Tel No.23387346/23098591-Ext.4342) i n Room No.10-A located in the Annexure Building of the Commission. The case records should explicitly indicate the status of the CAT/Court cases, the fact regarding the time limit for disposal of the case if any and extension sought for providing at least 3-4 months of time to the Commission for disposal of the case.
4. All Ministries/Departments are requested to adhere to the above procedure for submission of disciplinary cases involving Court cases to the Commission through single window system.
