Resolve of May Day

MAY DAY 2016

May Day as usual is the Day of inspiration to all the workers in the world. Though we are not in service anymore but retired from service, the May Day still continue to be a Day of inspiration too. As the international working class and the working class of India resolve to fight back the nefarious policies of Liberalization - Privatisation - Globalization, we the senior citizens and the Pensioners of AIPRPA also take the resolve to join with the working class in all places to oppose the dangerous LPG policies that did not spare the social security and pension also.

This May Day has to be observed to fight the designs of the Central Government to attack the social security including EPF, though on stiff opposition the attack has been deferred by the Finance Ministry. The fight for universal social security and protection of existing pension and social security laws must be intensified. Let us take the resolve that we shall embark on the task to defend the Social Security at any cost.

Let us observe May Day 2016 in all places:

Seventh Central Pay Commission has submitted its recommendations to Government on 19-11-2015. As most of the recommendations are retrograde and far below the expectations of the employees, the JCM National Council Staff side under the united banner of National Joint Council of Action (NJCA) strongly protested and demanded modification of the retrograde recommendations. It further decided to organise indefinite strike and letter conveying the decision was sent to the Cabinet Secretary.

Main demands raised by NJCA are: (1) minimum wage of Rs.26,000/- as against 18000 recommended by CPC, (2) upward revision of the fitment formula and application of the same in all pay scales in the pay matrix, (3) retention of percentage of HRA as 30%, 20% and 10% as against 24%, 16% and 8% recommended by CPC. (4) recommendation of the CPC to abolish important allowances should be rejected, (5) reject recommendations to discontinue all non-interest bearing advances, (6) reject the recommendation to reduce the salary to 80% for the second year of child care leave, (7) reject recommendations to impose more stringent conditions on MACP scheme such as “very good” benchmark, qualifying examination, re-introduction of efficiency bar etc. (8) modification in the parity-in-pension and acceptance of other minimum demands of pensioners and (9) Grant of Civil Servants Status to Gramin Dak Sevaks and extending all the benefits of departmental employees to Gramin Dak Sevaks on pro-rata basis. There are other demands also which are equally important.

Govt. constituted an Implementation Cell in the Finance Ministry to study the recommendations and submit its proposal to the Empowered Committee of Secretaries under the Chairmanship of Cabinet Secretary. Empowered Committee will submit final concrete proposals to Cabinet for approval. On receipt of the letter of NJCA addresed to Cabinet Secretary regarding indefinite strike, the Implementation Cell called the JCM staff side leaders to present its view points before the cell. Accordingly the NJCA leaders met the Convenor of Implementation Cell and explained the justification of each demands in the charter of demands.

NJCA decided to give strike notice on 11th March 2016 to commence the indefinite strike from 11th April 2016. At this stage the Cabinet Secretary invited the JCM National Council staff side leaders for discussion with Empowered Committee of Secretaries on 1st March 2016. The NJCA leaders attended the discussion and once again explained the justification of all demands before the Empowered Committee. Cabinet Secretary gave a patient hearing but made no commitment on any of the demands. He finally appealed the staff side to give some more time for the Government for inter-departmental consultations and to take a final view and decision on ech demand raised by the staff side in the charter of demands.

NJCA met and reviewed the whole situation and came to the conclusion that as the Government has appealed for some more time to take a decision, it will be appropriate on the part of the staff side to give time to the Government, so that later on Government cannot blame that NJCA went on sudden strike inspite of the appeal from the Government to give some more time. Secondly, Railways and Defence departments come under the purview of Industrial Dispute Act and as per the ID Act, if strike notice is served on 11th March 2016, strike should commence within six weeks from the date of serving notice, by which time the election in four states will not be over. Thirdly, as the Assembly elections in four states have been notified and election code of conduct has come into force, the employees of four states will find it difficult to join the strike as many of them will be drafted for election duty. Taking into consideration all the above aspects, the NJCA decided to defer the indefinite strike from April 11th to July 11th and to serve the strike notice on June 9th instead of March 11th.

Now the ball is in the Govt.’s court. Before June 9th, ie. date of serving strike notice, the Government will be getting seven month time from the date of submission of the 7th CPC report, to take a final decision on all the demands and also to come to a negotiated settlement with the staff side. Any further delay is unwarranted and unjustified and cannot be tolerated. If the Government take an adamant stand and reject the justified demands of the staff side, then we will be forced to serve notice for indefinite strike from July 11th. Government cannot take the staff side for granted.

AIPEU Group-C CHQ appeals to all the constituents of NJCA to take a firm stand and not to compromise on minimum demands. Let us also pledge that we will be second to none, in organising the indefinite strike in Postal and ensure cent per cent participation of our membership at gross root level in the impending strike.

Government does u-turn on EPF, agrees to 8.8 percent interest rate

Bowing to persistent pressure from trade unions and political parties, the Centre on Friday increased the interest rate on employees provident fund (EPF) deposits to 8.8 percent from 8.70 percent announced earlier for 2015-16.

"I am happy to tell you that the EPF rate has been increased to 8.8 percent," Labour Minister Bandaru Dattatreya told reporters in New Delhi.

The provident fund rate was 8.75 percent in 2014-15 and the Central Board of Trustees (CBT) had recommended to make it 8.8 percent for this fiscal. However, the finance ministry had rejected the recommendation and had approved only 8.70 percent interest, citing lower earnings.

"The protest was successful with workers across the country participating in it," Centre of Indian Trade Union (CITU) president A.K. Padmanabhan told IANS over phone.

Padmanabhan is also a member of the Central Board of Trustees (CBT) of EPFO.

Most trade unions had protested the decision and the issue was also raised by political parties both in parliament and outside.

Trade unionist and Communist Party of India-Marxist MP Tapan Kumar Sen had also raised it in the Rajya Sabha.

Trade unions had threatened to intensify their agitation from September if the government did not comply with the demand of higher EPF interest rates.

All India Trade Union Congress (AITUC) general secretary D.L. Sachdev termed the Friday protest call by the central trade unions as successful.

"We oppose even a slight reduction in the interest rate after the recommendation by the CBT. The CBT had recommended 8.8 percent whereas the central government reduced it to 8.7 percent," he said.

According to Padmanabhan, the argument that interest rates on public provident fund (PPF) and other small savings schemes have come down and the employees provident fund interest rate cannot be immune is not sustainable.

"The corpus belongs to the workers and the interest is paid out of income from the corpus," he said.

As the government decided to agree to 8.8 percent interest rate, Padmanabhan said this is the third time the BJP-led central government is backtracking on its decision faced with strong opposition.

On April 19, close on the heels of violent agitation in Bengaluru and also demand from trade unions, including from RSS-affiliated Bharatiya Mazdoor Sangh (BMS), the government had withdrawn its new rules of provident fund withdrawal.

Padmanabhan said EPFO has the necessary funds to pay higher interest rate.

"The CBT of EPFO is the final authority on the all matters. As per the EPF Act, the CBT has the full powers. All these years the central government agreed to the recommendations of the CBT," Padmanabhan said.

According to him, even with offering an interest rate of 8.95 percent, the EPFO will have a surplus of around Rs.91 crore.

Welcoming the government's decision, national secretary of the All India Trade Union Congress Vidya Sagar Giri told IANS: "If the government has rolled back its decision then it is good."

Calling the government's move anti-labour, Giri said: "The government is only worried about lending money to corporates at lower interest rate and that too on the cost of the poor labourers."

He also slammed the government for behaving like a dictator and said: "The government has become a dictator. The EPFO's CBT, the apex body during a meeting held in February this year, had proposed an interim rate of interest at 8.8 percent to be credited to the EPF subscribers for 2015-16 in the presence of Union Labour Minister Bandaru Dattareya."

"How the finance minister can overlook the decision of the apex body?" he wondered.

Sachdev, meanwhile, claimed that the central government "wants to dilute the PF and direct the funds to New Pension Scheme and also to the stock markets".

"Social security schemes cannot be left to the vagaries of the stock market," he said, adding that the government seems to be going towards the goal of making PF an optional scheme for the workers which is not good.

According to the new norms proposed earlier this year, subscribers would not be allowed to claim withdrawal of PF after attaining 54 years of age, and would have to wait till 57.

The earlier norms allowed contributors or subscribers to claim 90 percent of their accumulations in their PF account at the age of 54 years, and the final claims to be settled just one year before their retirement.

Cancellation of PRS counter tickets through IRCTC website and through 139 (IVRS and SMS)

Purpose:

To facilitate passengers having confirmed PRS counter tickets to cancel the ticket within the permitted time limit under Refund Rule 2015. PRS counter tickets can be cancelled through:

(i) IRCTC website (www.irctc.co.in) or

(ii) 139

The permissible refundable amount shall be collected only at the journey commencing station or nearby satellite PRS locations defined by Zonal Railway within the prescribed time limit.

Facility Available only for Fully confirmed system tickets:

· In normal circumstances only and not in case of late running of trains/cancellation of trains etc.,

· Where the mobile number has been given at the time of booking the ticket.

· Upto 4 hours before the scheduled departure of the train.

Collection of Refund Amount

· Refund of fare amount shall be collected only at the journey commencing station or nearby satellite PRS locations defined by Zonal Railway as under:-

(a) During first two hours of the opening of PRS counters on the next day for the tickets for the trains whose scheduled departure time is (i) between 1801 hours and 0600 hours.

(b) Upto 4 hours after the scheduled departure of the train during the working hours of PRS counters/current counters/special counters where cancellation is permitted round the clock on the ticketsfor the trains whose scheduled departure time is (i) between 0601 hours and 1800 hours.

Benefits:

Apart from cancellation across PRS counter, the passengers having confirmed PRS counter ticket can cancel the same within the prescribed time limit as per Refund Rule 2015 as under:-

(i). Through IRCTC website (www.irctc.co.in) (Steps how to cancel confirmed PRS counter ticket is placed at Annexure-I) or

(ii) Through 139 (Steps how to cancel confirmed PRS counter ticket is placed at Annexure-II)

CANCELLATION THROUGH IRCTC WEBSITE: (Annexure-I)

* A new page will be given on IRCTC website (www.irctc.co.in) without any login ID for purpose of cancellation of PRS counter tickets.

* Passenger will be asked to enter the PNR number & Train number along with captcha.

* The details entered by passenger shall be validated and an OTP will be sent to the passenger to his mobile number given at the time of booking the ticket. The OTP received on the mobile will be entered by the passenger in the web page and it will be validated by the system.

* After receiving the confirmation OTP number from the passenger, full cancellation of PNR will be done and PNR will be marked as Cancelled but not refunded in the system. Seat/berth will be released and would be made available for booking both at PRS & IRCTC Website. Refund amount due will also be displayed to the passenger on the website.

* An SMS will be sent to the passenger with PNR and fare details - ”Your ticket has been cancelled. PNR, xxxxxx, Amt,xxxxx. Refund of fare amount shall be collected only at the journey commencing station or nearby satellite PRS locations as per the notified time”.

* All the Privilege/Duty pass/PTOs/complimentary pass tickets shall be allowed to be cancelled through website or through 139.

* All types of PNRs including i-tickets (after printing) and system tickets booked across counter/post office/YTSK/Go India terminals/Bank terminals etc.’ will be allowed to be cancelled on website except the following:

(a). Circular Journey tickets and onwards tickets booked against CJT.

(b). Foreign tourists PNRs against which berth allotment has been done

(c). ATAS generated new PNR

(d). Duplicate ticket.

(e). Cluster ticket and pre-bought ticket.

CANCELLATION THROUGH 139: (Annexure-II)

Rail Ticket booked through Railway Reservation counter can be cancelled through Railway Enquiry 139. Service will be available on 139:

(a). IVR with Agent Assistance

(b). SMS Service

(a). Cancel through 139 using IVR(Agent Assistance)

(i). Customer will call on 139 and select Option ‘6’ from IVR main menu.

(ii). IVR will ask whether it is Counter Ticket or E- Ticket. Press 1 for Counter Ticket or Press 2 for E-Ticket.

(iii). In case customer selects E-Ticket option, IVR will play a message “Currently ticket booked through Railway Reservation Counter only can be cancelled through 139. Press 8 to go back to main menu”

1. Once customer selects Counter Ticket option, call will be transferred to agent for cancellation.

2. Agent will ask the following information from customer to process the cancellation.

a. PNR Number

b. Train Number

3. Agent will retrieve ticket information from the server and confirm it with the customer.

4. After ticket details confirmation, agent will click on “Generate OTP” button to generate the OTP. System will validate the calling number of customer with the number mentioned in ticket details from the system.

5. If mobile number validation fails, agent will advise the customer to call from the same number mentioned at the time of booking the ticket. If number is successfully validated, OTP will be delivered on passenger’s mobile number which he would convey to agent.

6. Agent will enter OTP on CRM and will click “Submit” button to process the cancellation. Ticket will be cancelled and refundable amount will be display on agent screen. Agent will communicate the same refundable amount to customer.

7. Customer has to collect the permissible refundable amount across the PRS counter within the prescribed time limit.

(b) Cancellation through SMS to 139:

(i). User has to send PNR Number & Train Number to 139 in the syntax given below:

CANCEL<PNR Number><Train Number> to 139

Example: CANCEL 2303529769 12420

(ii). User will get below response from 139 after mobile number verification:

“Dear User, We have received cancellation request against PNR number 2303529769, OTP against this request is 123456. To confirm ticket cancellation send SMS OTP 123456 to 139.

(iii). User has to send OTP number received back to 139 for second level of confirmation.

OTP <OTP received on Passenger Mobile Number> to 139

Example: OTP 123456

User will get below response from 139:

“Dear User, Your ticket with PNR number 2303529769 has been cancelled, refundable amount is Rs. ----.”

(iv) Passenger has to collect the permissible refundable amount within prescribed time limit across the PRS counter.
